Purpose:
To provide a clear and respectful protocol for accessing devices of a deceased individual, ensuring security, privacy, and ethical standards are upheld.
Policy Overview:
Neighborhood Nerds is committed to maintaining the highest ethical standards when handling requests for access to the devices of deceased individuals. This policy ensures that we verify the legitimacy of each request and protect both the privacy and rights of our Members and their families.
General Guidelines:
- Proof of Death Required:
Before granting access to a device belonging to a deceased person, obtain official proof of death, such as a death certificate or an obituary from a reputable source. This verification helps prevent unauthorized access, protecting the privacy of the deceased and their family. - Identity Verification:
Confirm the identity and relationship of the requester to the deceased. This could include documentation showing the requester as the executor of the estate, a close family member, or a designated representative with legal authorization. - Member Exception Clause:
For Existing Members: If the deceased is a known Member and we have an established relationship, exceptions may be made with discretion. This means we may not require a death certificate if the requester is a family member recognized in our records or someone previously authorized to manage the Member’s affairs. Our relationship with Members includes agreed-upon terms and conditions that grant us certain permissions under specific circumstances, making this possible.
Security, Privacy, and Ethical Standards:
- Privacy of Deceased: Only access and retrieve the specific files or information requested by the verified family member or legal representative. Do not explore unrelated data or files, as this would breach privacy and trust.
- Data Integrity: Handle all data with the utmost care, ensuring that any files retrieved are transferred securely and stored temporarily only if absolutely necessary.
- Confidentiality: Maintain strict confidentiality about the contents and nature of the information accessed.
Procedural Steps:
- Receive Request:
Document the initial request details, including the requester’s name, relationship to the deceased, and purpose of access. Explain the requirements for proof of death and identity verification to the requester. - Verify Documentation:
Review and confirm the provided documentation, such as a death certificate or legal authorization. If the requester is unable to provide these, politely decline the request, explaining our policy to safeguard privacy and security. - Access with Caution:
If all documentation is verified and access is granted, limit access strictly to the information requested. Use only secure methods to transfer any retrieved data, ensuring the requester has a secure way to receive the information. - Document the Access:
Log details of the access, including files retrieved, the purpose of the request, and any actions taken on the device. This documentation provides accountability and a record for future reference. - Secure Closure:
Ensure the device is securely locked or logged out after access, preventing any unintentional data exposure. Delete any temporary files stored during the process after confirming the requester has received them.

- Follow the Process Strictly: Deviation from this process is not permitted unless authorized by a supervisor, as it risks violating privacy and legal standards.
- Empathy and Professionalism: When dealing with bereaved family members, show empathy and professionalism. This can be a difficult time for them, and a supportive approach will enhance trust.
- Consult Management: If unsure or if the request seems unusual, consult with management before proceeding.
